1. Operator, Regulatory Status and Important Non-Custodial Notice

1.1. mexabits.com is owned and operated by Forecast Harbor N.V., a company incorporated under the laws of Curaçao with Company Number 168942, having its registered office at Kaya Isla di Futuro 27, Willemstad, Curaçao.

1.2. Forecast Harbor N.V. holds a valid Digital Prediction Market Technology Certificate of Operation No. DPM-CO-2026-0419 issued by the Curaçao Digital Commerce Registry.

1.3. Forecast Harbor N.V. has an application DPM/2026/3187/0924 for a prediction market technology services license in progress with the Curaçao Digital Markets Authority. Until that process is concluded, based on the transitional arrangement applicable to digital event-contract technology providers, the company is permitted to continue its operations under this Certificate of Operation.

1.4. IMPORTANT: YOU UNDERSTAND AND AGREE THAT WE ARE SOFTWARE DEVELOPERS AND PROVIDERS OF SOFTWARE SERVICES. WE DO NOT CUSTODY, CONTROL OR MANAGE USER FUNDS OR PRIVATE KEYS IN ANY MANNER WHATSOEVER, EXCEPT WHERE A SPECIFIC CUSTODIAL PAYMENT FEATURE IS EXPRESSLY OFFERED AND GOVERNED BY ADDITIONAL TERMS.

1.5. We enable access to an online, decentralized prediction market interface, autonomous protocol environment, smart contracts, market data tools and associated decentralized networks that are not fully controlled by the Company. We do not have access to your private keys and cannot initiate, reverse or cancel a transfer of your digital assets on your behalf.

1.6. Prediction markets involve significant risk. You may lose the entire amount committed to a trade, order, position, liquidity provision or market participation.

2. Acceptance of Terms

2.1. By registering on mexabits.com or using any part of the Website, including any sub-domain, source code, API, smart-contract interface, market interface or trading functionality, you enter into an agreement with Forecast Harbor N.V. and agree to be bound by:

  • these Terms and Conditions;
  • our Privacy Policy;
  • our Cookies Policy;
  • any market-specific rules, resolution rules, trading rules, fee schedules and promotional rules published on the Website.

2.2. These Terms and Conditions, together with the documents referenced above, are referred to as the "Terms", "Terms and Conditions" or "Agreement".

2.3. In these Terms, "You", "Your", "Yourself", "User" and "Trader" refer to the person using the Website or Services.

2.4. MEXABITS, "we", "us", "our" and the "Company" refer to Forecast Harbor N.V. and, where applicable, its affiliates, contractors, software providers and service providers.

2.5. Please read this Agreement carefully. If you have any doubts about your rights and obligations, you should not use the Website or Services until you have obtained independent advice.

2.6. If you do not accept these Terms, you must not use, visit or access any part of the Website or Services.

2.7. These Terms come into force as soon as you complete registration, connect a wallet, create an account, submit an order, trade a market, provide liquidity, claim settlement proceeds or otherwise use the Services.

2.8. We may amend these Terms at any time without prior notice. We may bring material changes to your attention by email, Website notice or other reasonable means. Your continued use of the Services after any amendment will be deemed acceptance of the amended Terms.

2.9. In the event of a conflict between these Terms and any market rules, trading rules or other documents referenced herein, these Terms shall prevail unless the relevant document expressly states otherwise.

2.10. These Terms may be published in several languages for convenience. The English version is the only legal basis of the relationship between you and us. In case of discrepancy, the English version prevails.

3. Description of the Service

3.1. MEXABITS provides software, interfaces and related services that allow Traders to access prediction markets, event contracts, order books, automated market makers, market information, price data, resolution data and related tools.

3.2. The Services may allow Traders to:

  • create or register an account;
  • connect a self-custodial wallet;
  • view prediction markets;
  • place orders;
  • buy, sell or hold event-contract positions;
  • provide or remove liquidity;
  • submit market-related information;
  • claim settlement proceeds;
  • participate in promotions, if available;
  • use APIs, charts, portfolio tools and market analytics.

3.3. The Company does not provide financial, investment, tax, legal or trading advice.

3.4. No information shown on the Website should be treated as a recommendation to buy, sell, hold or enter into any market position.

3.5. Prices, probabilities, charts, implied odds, order books, market depth, commentary and other market information are provided for informational purposes only and may be delayed, inaccurate, incomplete or affected by third-party data errors.

4. Account Registration

4.1. In order to access certain Services on mexabits.com, you must personally register an account with us or connect an approved wallet to create a MEXABITS account.

4.2. To register as a Trader and use the Website, you may be required to submit an application for registration and provide personal information, including email address, full name, date of birth, residential address, nationality, source of funds information and other information required for compliance purposes.

4.3. If the information required under Clause 4.2 is not provided, is incomplete, inaccurate, misleading or not up to date, MEXABITS reserves the right to suspend, restrict or reject your account registration and to treat any subsequent trading activity as invalid to the extent permitted by law.

4.4. Where your account is suspended, you should contact customer support at [email protected].

4.5. All applicants must be of legal age as determined by the laws applicable to them, whichever age is greater. MEXABITS reserves the right to request proof of age and suspend the account until satisfactory documentation is provided.

4.6. MEXABITS will not accept registration from individuals who:

  • are under the legal age of majority in their jurisdiction;
  • reside in or access the Services from a jurisdiction where prediction markets, event contracts, online trading, crypto-asset trading or similar services are illegal or not permitted;
  • provide misleading information;
  • attempt to register on behalf of a third party;
  • are subject to sanctions, watchlists or other legal restrictions.

4.7. MEXABITS reserves the right to refuse any application for an account at its sole discretion.

4.8. You represent and warrant that all information provided by you during registration, verification and ongoing use of the Services is true, complete, accurate and up to date.

4.9. MEXABITS reserves the right, at any time, to request any KYC, KYB, AML, sanctions-screening, source-of-funds or source-of-wealth documentation it deems necessary to determine the identity, location, eligibility and compliance status of a Trader.

4.10. MEXABITS reserves the right to restrict the Services, trading, deposits, withdrawals, settlement claims, market access or account access until identity, location, source of funds or other compliance matters are sufficiently determined.

4.11. Verification data may be processed by third-party providers, including VeriGate Compliance Ltd., ChainTrace Analytics Ltd. or another provider selected by the Company. Data may be transmitted in encrypted form and processed in accordance with our Privacy Policy.

5. One Account per Trader

5.1. Only one MEXABITS account per Trader is allowed.

5.2. If you attempt to open or successfully open more than one account, whether under your own name, another name, another wallet or through another person, MEXABITS may immediately suspend or close all related accounts.

5.3. If MEXABITS has reason to believe that you have registered or used more than one account, or colluded with other individuals using multiple accounts, MEXABITS may treat such accounts as linked accounts and suspend or close them.

5.4. MEXABITS may withhold trading proceeds, settlements, promotional credits or other amounts until you demonstrate that no breach of these Terms occurred.

5.5. If you become aware that you have more than one registered account, you must notify us immediately. Failure to do so may result in account restriction, suspension or closure.

6. Account Security

6.1. It is your sole responsibility to keep your login credentials, wallet credentials, private keys, seed phrases, devices and authentication methods secure.

6.2. You must not disclose your login details, private keys, seed phrases, API keys or authentication credentials to anyone.

6.3. We are not liable for any abuse, misuse, unauthorized access, unauthorized trade, unauthorized wallet transaction or loss caused by your disclosure of credentials, whether intentional, accidental, active or passive.

6.4. You are prohibited from selling, transferring, assigning, leasing, sharing or acquiring accounts from or to other Traders.

6.5. You are responsible for all activities that occur under your account, wallet connection, API key or device.

6.6. We recommend that you enable two-factor authentication and other security measures offered by the Website.

6.7. We may suspend or terminate your account at any time, with or without notice, if we suspect that your account, wallet, credentials or API access has been compromised or used in breach of these Terms.

6.8. We take no responsibility for any loss or damage resulting from unauthorized access to your account or your failure to keep credentials secure and private.

7. Account Suspension and Closure

7.1. MEXABITS may close, suspend, restrict or limit your account if:

  • we consider that you are using or have used the Website in a fraudulent, manipulative, collusive, unlawful or improper manner;
  • we consider that you have used the Website unfairly, exploited errors, manipulated markets or taken unfair advantage of MEXABITS, other Traders or market participants;
  • your account is being used for the benefit of a third party;
  • we are requested to do so by police, a regulator, a court, a sanctions authority or another competent authority;
  • we are unable to verify your identity, location, source of funds, profession, trading purpose or eligibility;
  • you breach these Terms, applicable law, market rules or fair-use rules;
  • we consider that any of the above events may have occurred or are likely to occur.

7.2. If MEXABITS closes or suspends your account for any reason listed in Clause 7.1, you shall, to the extent permitted by applicable law, indemnify and hold MEXABITS harmless for claims, losses, liabilities, damages, costs and expenses arising from such breach.

7.3. In such circumstances, MEXABITS may void, cancel, reverse, restrict, freeze or withhold any orders, trades, positions, promotional credits, settlement proceeds or withdrawals to the extent permitted by law.

7.4. If MEXABITS closes your account, it will inform you of any available means to withdraw or claim any remaining balance or eligible settlement proceeds, subject to law, compliance requirements and protocol limitations.

8. Representations and Warranties

8.1. Prior to your use of the Services and on an ongoing basis, you represent, warrant, covenant and agree that:

8.1.1. Capacity

  • you are over the legal age of majority as determined by any laws applicable to you, whichever age is greater;
  • you have full legal capacity to enter into a binding agreement with us;
  • you are not restricted by any form of limited legal capacity;
  • you are not prohibited from participating in prediction markets, event contracts, crypto-asset trading or similar services.

8.1.2. Jurisdiction

  • you are accessing mexabits.com from a jurisdiction where it is legal for you to do so;
  • you will not use the Services while located in any jurisdiction that prohibits prediction markets, event contracts, crypto-asset trading, online trading or similar services;
  • you accept and acknowledge that we may use techniques to detect and prevent prohibited access, including device analysis, geolocation, IP analysis, VPN/proxy detection, transaction monitoring and blockchain analytics.

8.1.3. Funds, Assets and Tax

  • you are solely responsible for reporting and accounting for taxes applicable to you under relevant laws;
  • you are solely responsible for taxes payable on crypto-assets, fiat currency, trading proceeds, settlement proceeds, rewards or promotional credits;
  • you understand that there is a risk of losing crypto-assets, fiat currency or other value when using the Services;
  • you will not deposit, trade or use funds that originate from criminal, unauthorized, sanctioned or unlawful activity;
  • you will not use payment methods, wallets or accounts that do not belong to you or that you are not authorized to use;
  • all funds or assets committed through the Website shall be used only for Services available on the Website;
  • you will not withdraw, claim or transfer funds to payment methods, wallets or accounts that do not belong to you;
  • you understand that by participating in prediction markets, you may lose the full amount committed to any trade, position or market;
  • you acknowledge that the value of crypto-assets can change dramatically;
  • MEXABITS shall not be treated as a bank, broker, exchange, investment adviser, financial institution, fiduciary or custodian unless expressly stated in separate written terms.

8.1.4. Trading Conduct

  • your use of the Services is at your sole option, discretion and risk;
  • you will not conduct criminal activities through your account;
  • all information provided by you is true, complete and correct;
  • you will immediately notify us of any change to such information;
  • you participate in markets on your own behalf and not on behalf of any other person unless expressly approved by us;
  • you have only one account and will not open additional accounts;
  • telecommunications networks and internet access required to use the Services are beyond our control;
  • you will not be involved in fraudulent, collusive, manipulative, wash trading, spoofing, layering, market fixing, oracle manipulation, information misuse or other unlawful activity;
  • you will not use software-assisted methods, bots, scripts, devices or APIs in a manner that breaches these Terms or applicable trading rules;
  • if you have access to material non-public information related to an event, market, outcome, oracle, resolution source or settlement process, you will not trade on any affected market;
  • if you are an official, employee, contractor, agent, insider, auditor, election worker, data provider, oracle operator, event organizer, referee, regulator, issuer, campaign member or any person with authority or influence over an event outcome, you will not trade on markets where your role may affect or appear to affect the outcome;
  • if you are involved in determining, reporting, verifying or resolving an event, you will not trade on that event or assist others in doing so;
  • you will not manipulate, attempt to manipulate or interfere with the data source, oracle, reporting mechanism, market resolution process or settlement process.

8.2. In case of a breach of any representation, warranty or covenant in this Clause 8, MEXABITS may close or suspend your account and void, cancel, restrict or reverse relevant activity to the extent permitted by law.

9. No Financial Advice

9.1. The Services are provided for informational, technological and market-access purposes only.

9.2. MEXABITS does not provide financial, legal, tax, investment, trading, accounting or other professional advice.

9.3. Any market description, probability, price, chart, commentary, forecast, data feed, news item, social signal or educational content is not advice and should not be relied upon as such.

9.4. You are solely responsible for your trading decisions, risk management and compliance with applicable law.

10. Deposits, Wallets and Funding

10.1. Depending on the Services available in your jurisdiction, you may access markets by using:

  • a self-custodial crypto wallet;
  • a third-party payment provider;
  • a hosted balance or account feature, if offered;
  • any other payment or settlement method available on the Website.

10.2. You must use only payment methods, wallets and accounts owned or lawfully controlled by you.

10.3. You shall ensure that funds or assets used through the Services are not tainted with illegality and do not originate from unlawful activity.

10.4. You should only commit funds or assets for the purpose of using the Services, including placing orders, entering trades, holding positions, providing liquidity, paying fees or claiming settlements.

10.5. MEXABITS may suspend or close your account if it reasonably believes you are depositing or routing funds without a legitimate intention to use the Services or for purposes of money laundering, sanctions evasion, fraud or abuse.

10.6. If MEXABITS discovers or suspects that you:

  • funded or are funding your account using third-party payment methods;
  • used wallets or accounts not owned or controlled by you;
  • funded or are funding your account with funds tainted by illegality;
  • used mixers, tumblers, sanctioned addresses or high-risk transaction patterns;

then such activity may be deemed a violation of these Terms.

10.7. In such circumstances, MEXABITS may:

  • suspend or close your account;
  • cancel, reverse, reject or adjust transactions;
  • restrict trading or withdrawals;
  • forfeit promotional credits;
  • report the activity to relevant authorities.

10.8. MEXABITS may set minimum and maximum deposit, transfer, trade, order or withdrawal amounts at its discretion.

10.9. Payment methods and limits may be displayed in the wallet, cashier, portfolio or account section of the Website.

10.10. Additional fees may be charged by payment providers, blockchain networks, bridge providers, wallet providers, banks or other third parties.

10.11. Deposits or transfers may be processed immediately or may require network confirmation, payment provider approval, internal review or compliance checks.

10.12. MEXABITS is not responsible for delays caused by blockchain congestion, payment providers, banks, wallets, bridges, validators, sequencers or other third parties.

10.13. Funds or assets cannot be transferred from your account to another Trader's account unless such feature is expressly supported and permitted by the Website.

10.14. Users whose accounts are blocked, restricted or suspended must not attempt to deposit or transfer funds through the Website.

11. Withdrawals and Settlement Claims

11.1. MEXABITS reserves the right to refuse, delay or restrict any withdrawal, transfer or settlement claim until:

  • your identity has been verified;
  • your ownership or control of the destination wallet or payment account has been verified;
  • any additional information requested by MEXABITS has been provided;
  • you have complied with applicable compliance, AML, sanctions, market and promotional requirements;
  • the relevant market has been finally resolved and settlement is available.

11.2. MEXABITS reserves the right to investigate your account, wallet activity, trading activity, market activity and blockchain transactions.

11.3. If MEXABITS reasonably suspects that your account or activity has violated these Terms or applicable law, it may delay or decline deposits, withdrawals, trading, settlement claims or access while it conducts an investigation.

11.4. You acknowledge that MEXABITS may not be able to provide details of any investigation.

11.5. Withdrawals should be made through the same payment method or wallet used for funding where required by AML policies, payment provider rules or applicable law.

11.6. If you used multiple payment methods, MEXABITS may split withdrawals across such methods.

11.7. If we mistakenly credit your account with assets, proceeds, rewards or settlement amounts that do not belong to you, the amount remains our property or the property of the relevant protocol, market or rightful owner and may be deducted, reversed or reclaimed.

11.8. If you withdraw or transfer assets that were mistakenly credited, the mistakenly paid amount shall constitute a debt owed by you to us or the relevant rightful owner.

11.9. You must notify us immediately if you become aware of any incorrect credit, incorrect settlement or mistaken payment.

11.10. The minimum withdrawal amount will be shown on the Website when performing a withdrawal.

11.11. MEXABITS may charge withdrawal, processing, service or administrative fees at its discretion. Third-party fees, including bank, payment provider, network and gas fees, are your responsibility.

11.12. Crypto withdrawals will be made to the wallet address specified by you. You are solely responsible for ensuring that the address, network, memo, tag or destination details are correct.

11.13. MEXABITS is not responsible for losses caused by incorrect wallet addresses, wrong networks, incompatible tokens, missing memos, wallet compromise or blockchain finality.

12. Anti-Money Laundering and Sanctions

12.1. All transactions may be checked to prevent money laundering, terrorist financing, fraud, sanctions evasion, market manipulation and other unlawful activity.

12.2. If you become aware of suspicious activity relating to any market, trade, wallet, account or settlement, you must report this to MEXABITS immediately.

12.3. MEXABITS may suspend, block or close an account and withhold funds, assets, positions or settlement proceeds if required or permitted by applicable law, regulation, court order, sanctions authority or competent authority.

12.4. The Services are not offered to individuals or entities subject to United Nations, United States, European Union, United Kingdom, Curaçao or other applicable sanctions or watchlists.

12.5. By using the Services, you represent and warrant that you are not subject to such sanctions or restrictions.

13. Prediction Market Trading Rules

13.1. You may place orders, enter trades, acquire or sell positions, provide liquidity or otherwise participate only in markets offered through the Website.

13.2. MEXABITS is not obliged to accept, route, display, execute or process any order, trade or position.

13.3. Orders and trades will be deemed valid only when confirmed by the Website, matching engine, smart contract, blockchain transaction, order book or other relevant system.

13.4. Orders, trades or positions are accepted only online, including through the Website, mobile interface, API or approved smart-contract interface. Orders received by post, email, fax or unsupported channels are invalid.

13.5. It is your responsibility to ensure that order details, market selection, outcome selection, price, size, direction, expiry, slippage, network, wallet and transaction details are correct.

13.6. Once an order has been submitted, executed or confirmed, it may not be cancellable by you unless the Website, protocol or smart contract expressly permits cancellation.

13.7. MEXABITS may cancel, reject, void or amend an order, trade or position if:

  • the market has been suspended, cancelled, resolved, invalidated or closed;
  • there was an obvious error in price, market description, order book, resolution source, interface display or settlement logic;
  • the order was placed in breach of these Terms;
  • the order was placed by an ineligible Trader;
  • cancellation is required for legal, compliance, security or regulatory reasons;
  • the relevant smart contract, oracle, data source or network fails or is compromised.

13.8. Your funds or assets may be allocated to orders or positions in the order they are placed and may not be available for other use while locked, escrowed, committed or pending settlement.

13.9. MEXABITS may void or reverse transactions involving allocated funds where permitted by law, protocol rules or these Terms.

13.10. Orders placed with insufficient funds, insufficient allowance, insufficient gas, invalid signature or invalid wallet authorization may be void.

13.11. Each valid trade or order may receive a unique transaction code, order ID, hash, signature or blockchain transaction identifier.

13.12. We shall not be liable for settlement of any order or trade that is not confirmed by the relevant system.

13.13. If you are unsure about the validity of an order, trade or position, you should check your account history, wallet activity, portfolio page, order history or contact Customer Support.

13.14. Should a dispute arise regarding the content, timing, status or validity of an order or trade, you and MEXABITS agree that the relevant system logs, blockchain records, smart-contract state, order book records and internal control logs shall be authoritative to the extent permitted by law.

14. Market Creation, Suspension and Resolution

14.1. Markets may relate to future events, public outcomes, economic data, elections, sports outcomes where permitted, cultural events, technology events, crypto events, corporate events or other verifiable outcomes.

14.2. Each market may have specific rules, including market question, eligible outcomes, trading period, resolution source, resolution criteria, invalidation criteria, settlement method, dispute process, fees and other special conditions.

14.3. You agree to review all market rules before trading.

14.4. MEXABITS may suspend, close, cancel, invalidate or modify a market where:

  • the market contains an error;
  • the event becomes impossible to resolve;
  • the resolution source becomes unavailable or unreliable;
  • the market question is ambiguous;
  • the market is affected by manipulation, fraud or unlawful activity;
  • required by law, regulation, court order or competent authority;
  • necessary to protect users, the protocol, the Website or market integrity.

14.5. Market resolution may be performed by an oracle, third-party resolver, decentralized dispute system, data provider, administrative review process or other mechanism specified in the market rules.

14.6. MEXABITS does not guarantee that any oracle, data provider, resolver or dispute system will be error-free, timely, uninterrupted, accurate or immune from manipulation.

14.7. Final settlement will occur only after the relevant market is resolved according to its rules and any dispute period has expired or concluded.

14.8. MEXABITS may withhold or delay settlement where there is a dispute, suspected manipulation, technical issue, legal issue or compliance concern.

15. Market Integrity and Prohibited Trading

15.1. You must not use the Services for: market manipulation, wash trading, spoofing, layering, self-trading, collusive trading, artificial volume generation, oracle manipulation, outcome manipulation, insider trading, trading based on material non-public information, front-running prohibited by applicable rules, abusing latency, bugs, stale prices or display errors, creating multiple accounts to bypass limits, circumvention of jurisdictional restrictions, money laundering or sanctions evasion.

15.2. You must not attempt to influence, corrupt, bribe, threaten, manipulate or interfere with any data source, oracle, resolver, event participant, official, publisher, reporter, employee or service provider involved in an event or market resolution.

15.3. If you are involved in the event underlying a market, or have authority, influence or privileged information regarding that event, you must not trade that market.

15.4. MEXABITS may monitor accounts, orders, trades, wallet activity and market behavior to detect prohibited conduct.

15.5. If prohibited conduct is suspected, MEXABITS may suspend accounts, cancel orders, void trades, freeze settlement proceeds, restrict withdrawals, report activity to authorities and take legal action.

16. Promotions, Rewards and Bonuses

16.1. MEXABITS may, at its sole discretion, offer promotions, rewards, trading credits, fee rebates, referral campaigns, liquidity incentives, market-maker programs, coupons, leaderboard campaigns or other special offers.

16.2. All promotions are subject to specific promotional terms and conditions published on the Website.

16.3. By accepting a promotion, you agree to the applicable promotional terms.

16.4. Promotional credits may be restricted, non-withdrawable, time-limited, subject to trading requirements or usable only in specified markets.

16.5. MEXABITS may withdraw, amend, cancel or suspend any promotion at any time.

16.6. If MEXABITS believes that a Trader is abusing or attempting to abuse a promotion, MEXABITS may deny, withhold or withdraw the promotion, terminate access to Services, lock the account temporarily or permanently, and void associated trades or rewards.

16.7. Creating multiple accounts to obtain promotions, referral rewards, fee rebates or incentives is prohibited.

16.8. MEXABITS reserves the right to remove promotional credits from inactive accounts or accounts identified as promotion abusers.

17. Fees

17.1. MEXABITS may charge trading fees, settlement fees, withdrawal fees, market creation fees, liquidity fees, protocol fees, gas fees, service fees or other fees.

17.2. Applicable fees may be displayed on the Website, order confirmation screen, transaction preview, fee schedule or smart-contract interface.

17.3. Fees may change at any time.

17.4. Third-party fees, including blockchain network fees, payment provider fees, bridge fees, bank fees, currency conversion fees and wallet fees, are your responsibility.

18. Prohibited Jurisdictions

18.1. Persons located in or resident in the following jurisdictions are not permitted to use the Services:

  • Afghanistan;
  • Belarus;
  • Cuba;
  • Curaçao, unless expressly permitted;
  • Democratic Republic of the Congo;
  • Iran;
  • Iraq;
  • Liberia;
  • Libya;
  • North Korea;
  • Russia, where prohibited by applicable sanctions or local law;
  • South Sudan;
  • Sudan;
  • Syria;
  • United States of America, including its territories and possessions;
  • Yemen;
  • Zimbabwe;
  • any jurisdiction subject to applicable sanctions or where the Services are unlawful.

18.2. The foregoing restrictions apply equally to citizens and residents of other countries while located in a prohibited jurisdiction.

18.3. Any attempt to circumvent jurisdiction restrictions is a breach of these Terms.

19.4. For users accessing the Services through mobile devices, MEXABITS is not responsible for damage to the device, data loss, call charges, data charges or other fees incurred while using the Services.

20. Acceptable Use

23. Errors, Obvious Errors and Bad Faith

23.1. MEXABITS will not be liable if you attempt to obtain or obtain an advantage from errors on the Website, including where:

  • there is an obvious error in market price, implied probability, chart, order book, spread, settlement amount or market description;
  • MEXABITS continues to accept orders on closed, suspended or resolved markets;
  • MEXABITS incorrectly calculates or displays a settlement amount;
  • a market is resolved incorrectly due to data-source, oracle, resolver or human error;
  • an error occurs in a smart contract, matching engine, API, indexer, charting system or data feed.

23.2. If you become aware of any error, you must notify us immediately.

23.3. MEXABITS may void, cancel, reverse, adjust or correct any affected order, trade, position, settlement or payment to the extent permitted by law and technically possible.

MEXABITS shall not be liable for: market losses; incorrect trading decisions; volatility; liquidity shortages; slippage; failed transactions; smart-contract bugs; oracle failures; blockchain reorganization or forks; wallet compromise; third-party service failures; regulatory changes; tax consequences; inaccurate market data; suspended or cancelled markets.

28.3. Nothing in these Terms shall exclude or limit liability for death or personal injury resulting from negligence where such exclusion is prohibited by law.

29. Indemnity

29.1. You agree to fully indemnify, defend and hold harmless MEXABITS, its affiliates, shareholders, directors, officers, agents, contractors, employees, licensors and service providers from and against all claims, demands, liabilities, damages, losses, costs and expenses, including legal fees, arising from:

33. Assignment

33.1. MEXABITS may assign, transfer, charge, sublicense, subcontract or otherwise deal with this Agreement or any rights and obligations under it at any time without notice.

33.2. You may not assign or transfer any of your rights or obligations under this Agreement without our prior written consent.

34. No Waiver

34.1. No waiver by MEXABITS of any breach of these Terms shall be construed as a waiver of any subsequent breach of the same provision or any breach of another provision.

34.2. Failure by MEXABITS to require strict performance of any provision shall not constitute a waiver of our right to enforce that provision later.

35. No Third-Party Rights

35.1. Nothing in this Agreement creates or confers any rights or benefits in favor of any third party not party to this Agreement, except where expressly stated.

36. No Partnership or Fiduciary Relationship

36.1. Nothing in this Agreement creates or shall be deemed to create a partnership, agency, trust arrangement, fiduciary relationship, employment relationship, broker relationship, advisory relationship or joint venture between you and MEXABITS.

36.2. MEXABITS does not act as your fiduciary, broker, investment adviser, portfolio manager, agent or custodian.

37. Entire Agreement

37.1. This Agreement constitutes the entire understanding and agreement between you and MEXABITS regarding the Services.

37.2. This Agreement supersedes any prior agreement, understanding, arrangement, statement or representation between you and MEXABITS relating to the Services.
